Below is an attachment of the letter i recieved from 3g uk, i would like to sent them a response letter back, so if any one has any ideas please do let me know...

Its a joke if you ask me

Dear Sirs,

Re: Handset Unlocking Activities

It has come to our attention that you are offering the ability to unlock handsets which are locked to the network owned and operated by Hutchison 3G UK Limited (trading as “3”).

Under the Terms for 3 Services ( copy enclosed), subscribers are not permitted to allow their handset to be unlocked from 3’s network in any unauthorized manner. In addition, subscribers are only permitted to request that their handset be unlocked from 3’s network by 3, subject to payment of all outstanding charges due and on condition that any subsidy in the handset has been repaid to us. By performing the unauthorized handset unlock for subscribers without such subscribers having paid the charges required under our terms, you are inducing the subscribers to breach our Terms for 3 Services, for which we hold you responsible.

In addition, as you are not an authorized reseller for 3, any advertisement displaying 3’s copyright materials and brand logo and trademarks without prior authorization infringes our intellectual property rights and, as you are not licensed to display our brand, you must immediately remove any materials with our brand from display.

If you do not immediately cease unauthorized unlocking of handsets locked to 3’s network and arrange the removal of any materials showing 3 brand from display, we will consider issuing legal proceedings against you.

Thats bad news...thats makes me think a new wave in gsm world is coming...may be soon all over the world unloking will be illegal..and we will loose the opertunity to make oney in easy way...I dont like tendecys which are coming..also in hardware...The big companys and operators makes everithing to kill people like us...thats a pity...

Right the way I see it is, if you buy the phone, it is yours, there for you should be able to do with it, anything you like. Most other countries, do not lock handsets to their network, it is mainly UK only that do this. I heard that ofcom were planning on stopping networks from locking handsets, as it is mainly Orange, T-mobile, and three that do this. O2 and voda do it on more feature packed handsets, and I was told that three handsets sold in Sweden are not locked.

don't reply.
Then you acknowldge you have received the letter..
don't respond to it and remove 3 brandings (they are right about that)

then no harm will come :)

I agree,

Until it is resolved with JIC Electronics, it is best to remove all 3 symbols etc

You could post this back to them which is a quote from their own boss
"However, Shaun Whyman, NEC (UK) head of cellular (pictured), said the manufacturer viewed this as ‘more of an IP infringement’ than an attempt to stop people unlocking phones.

‘It has been brought to our attention that there is a possibility that our IP has been infringed,’ he told Mobile. ‘We believe there is software out there that infringes NEC software IP.

‘We don’t want to be unfair to dealers [and repair companies]; we’re trying to protect our IP rather than go on a witch-hunt.’"

The point you could make to them is that:-
(A) you do not use NEC codes to unlock phones
(B) your own boss says that it is NOT to stop people unlocking phones (Which is NOT illegal)
(C) Ask them to provide the evidence which justifies the request
(D) Ask them to wait until the outcome of the JIC electronics vs NEC is decided.

Finaly, regardless of what their agreement says, the phone owner is making his/her own desicion on if they want the phone unlocked or not, their agreement is with the owner and not you and as such the agreement has nothing to do with you, and is not enforcable on you in law.

Just because NEC think themselves so big they think they can run rough shod over everyone, ask them this, Why are they so frightened of having their phones unlocked, why is it that NOKIA, SAMSUNG, PANASONIC etc etc are not bothered or is it that they are afraid of losing their £115 charge for each phone they unlock. What do I think of 3 over this :mad:

Steve, do U remember the letter which dr.bizar has uploaded here 2 years ago...war starting again...in USA unlocking 3 is federal crime...besides for example..moto c115 costs in my country 35EUR...repairing of 3310 for network costs arpund 15EUR..what will U do...Ill buy a ne phone...and some more..tendency is...everithing to be in one chip...sealed..not much to do...Ill stop here..lets wait...and see..now I prefer to develop things..not to repair...
